Agreeing to these terms

The Site at viaterza.com (the “Site”) is operated by The Virtual Specialist LLC, doing business as Via Terza (“Via Terza,” “we,” or “us”). By using the Site, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the Site. We may update these terms from time to time, and the date above shows when they were last revised.

What this Site is

The Site introduces Via Terza, a luxury travel and lifestyle advisory, and lets you start a conversation with us. Content on the Site is provided for general information. It is not an offer to sell travel, and nothing on the Site creates an advisory relationship until we have agreed to work together.

Working with Via Terza

Our services, fees, payment terms, and cancellation policies are set out in a separate written agreement or proposal provided to you when you engage us. If anything in that agreement differs from these terms, the agreement governs the services we provide to you.

Travel suppliers

Travel is delivered by independent third parties such as hotels, airlines, cruise lines, yacht operators, villa owners, transportation providers, and restaurants. Via Terza arranges and coordinates these services on your behalf but does not own or operate them. Each supplier’s own terms, policies, and pricing apply to the services it provides. Itineraries, availability, schedules, and prices can change, and we are not responsible for acts, omissions, delays, or changes by suppliers or events beyond our reasonable control.

Using the Site

You agree to use the Site lawfully and to provide information that is truthful and accurate when you contact us. You agree not to:

• use the Site for any unlawful, fraudulent, or misleading purpose, or impersonate another person;
• send spam, malicious code, or anything intended to disrupt or damage the Site or its users;
• attempt to gain unauthorized access to the Site, its servers, or any related systems.

Intellectual property

The Site’s text, design, logo, name, photography, video, and other content are owned by The Virtual Specialist LLC (d/b/a Via Terza) or used with permission from their owners, and are protected by copyright and other laws. You may view the Site for your personal use, but you may not copy, modify, distribute, or reuse its content for commercial purposes without our written permission.

Links to other sites

The Site may link to websites operated by others. We do not control those sites, and a link is not an endorsement. Their content and policies are the responsibility of their owners.

Your inquiries

Information you send through the inquiry form is handled as described in our Privacy Policy. Submitting an inquiry does not obligate you or Via Terza to enter into any arrangement.

To the fullest extent permitted by law, The Virtual Specialist LLC, doing business as Via Terza, along with its members, managers, and employees, will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or reliance on its content. Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute relating to the Site will be brought in the state or federal courts located in Florida.

If a provision does not apply

If any part of these terms is found to be unenforceable, the rest remains in effect. Our not enforcing a right at any time is not a waiver of that right.
